Important: Ensuring Data Integrity and Compliance in MLS Listings

At WMLAR, our foremost priority is to maintain the integrity of the data within the MLS. It is essential that dates, commissions (currently), and other fields accurately reflect the details specified in the contract. Any discrepancies will be rectified by designated WMLAR staff members, Andrea (h19155).

We have consistently observed errors where the dates and commissions on contracts do not align with those advertised in the MLS. Notably, there are frequent mismatches regarding commissions listed for subagents (SA) in the contracts compared to what is recorded in the MLS.

It is crucial to clarify that a subagent (SA) is not the same as a selling agent. According to Michigan Compiled Laws (MCL) Section 339.2517: “A subagent is one who has agreed to work with the listing agent, and who, like the listing agent, acts solely on behalf of the seller. Seller’s agents and subagents will disclose to the seller known information about the buyer which may be used to the benefit of the seller.”  In essence, a subagent introduces a buyer without an agency agreement with that buyer and works exclusively for the seller in conjunction with the listing agent.

Moreover, a Transaction Coordinator (TC) is responsible solely for managing the paperwork between the buyer and seller and does not have any fiduciary obligations.

It is also imperative that all contracts and amendments include the signatures of the listing agent and all legal property owners. We have identified numerous instances of contracts either missing signatures or not being uploaded at all, which is also a violation of MLS policy.

We appreciate your attention to these matters to ensure compliance and accuracy within our MLS system.
