DLARA State Law Compliance

To all WMLAR Members:

WMLAR has received reports of marketing using “Your Name Real Estate” If “Your Name Real Estate” is a licensed brokerage in Michigan, that’s perfectly fine. However, in most cases reported to WMLAR, it is not a licensed brokerage. If that applies to you, be sure to include your actual brokerage information in all marketing materials to stay compliant.

MCL – Section 339.2512e
Per the Occupational Code, advertising of listings MUST be under the broker name and phone number or street address as is required: “Any advertising displayed or published on or after January 1, 2018, that includes the name of an associate broker, a salesperson, or a cooperating group of associate brokers or salespersons employed by the same real estate broker, shall include all of the following:

  • The telephone number or street address of the employing broker.
  • The business name of the employing broker, in equal or greater type size than the name of the associate broker, salesperson, or cooperating group.”

The business name of the employing broker, in equal or greater type size than the name of the associate broker, salesperson, or cooperating group.”

When advertising properties adjust all of your social platforms, website, and marketing both online and otherwise your Brokerage name and phone number/street address.

When advertising your services include, at a minimum, your Brokerage name in at least the same size as your team name.

As a reminder, just because the Department of Licensing and Regulatory Affairs is not enforcing this rule, it does not mean they can’t or won’t.  We’re here to help prevent issues for you—stay ahead and stay compliant!
