NEXT LEVEL SUCCESS WEBINAR: FinCEN Residential Real Estate Reporting Rule

Beginning March 1, 2026, a significant federal rule will impact certain residential real estate transactions — and REALTORS® need to be prepared that’s why we added another class to March’s line-up of Next Level Success webinars. This course will be ZOOM ONLY from 2-3 p.m. on March 10. Thank you to our friends at ATA National Title for sponsoring this important content! (This course does include 1 hour of CE Marketplace LEGAL credit.)

The Financial Crimes Enforcement Network (FinCEN), a bureau of the U.S. Department of the Treasury, combats money laundering, terrorist financing, and other financial crimes. FinCEN collects and analyzes financial transaction data to protect the U.S. financial system.

Historically, many all-cash real estate transactions have operated outside of federal anti-money laundering (AML) reporting requirements — making real estate an attractive vehicle for illicit activity. FinCEN’s new Residential Real Estate Reporting Rule aims to close that gap.

What Does the Rule Do?

Effective March 1, 2026, certain residential transactions will require reporting when:

  • The buyer is a legal entity (such as an LLC, corporation, or partnership), and
  • The purchase is made in cash or financed through a lender that does not have federal AML reporting obligations.

Title and settlement agencies will be responsible for filing reports with FinCEN — but REALTORS® play a critical role in helping ensure required information is gathered accurately and on time.

Why Should REALTORS® Care?

Because reportable transactions cannot close until all required data has been collected and submitted.

If agents don’t understand:

  • Which transactions trigger reporting,
  • What information must be collected,
  • And when it must be gathered,

Closings could be delayed — potentially jeopardizing deals and client relationships.

Understanding this rule protects:

  • Your transaction timelines
  • Your clients
  • Your professional reputation
